LATEST CHANGES ON WORKING IN JAPAN 2019

Japan is currently facing a serious shortage of human resources, especially in the construction, mechanical, electrical - electronic, information technology, nursing industries fields, etc. Therefore, to attract foreign workers, the Government of Japan will conduct changes of policy on labor export in Japan in 2019.
It is expected that there will be a final decision by the end of March 2019. If approved, the labor export program to Japan in 2019 will have a positive change for employees and will be applied from April 2019.

1- In 2019, Japan opens the labor market

Japan passes a bill to open the labor market
According to the bill, from April 2019, the visa issuance system for employees coming from abroad will take effect. It is applied to 14 areas, including nursing, construction and agriculture. These are 3 fields that are seriously lacking human resources in Japan.
According to the new visa system with the name of Special skills, foreign employees will be accepted under 2 types of visas:
 
Hop Bao Nhat

Type I Visa (Special Skill Program No.1)
+ Benefit: Extended for up to 5 years
+ Applied to 14 different business fields
+ Requirements: It is required competence, experience as well as higher Japanese level than Skilled trainee program.
- The foreign employees who have attended a 3-year internship program do not need to take Japanese and technical tests.
- The employees with type I visas will not be able to bring their families to Japan
Type II Visa (Special Skill Program No. 1)
+ Expected application is limited to 2 areas: shipbuilding and construction.
+ Requirements: Employees must have high skills and pass high-level skill tests
+ Benefit: Extended long term after 5 years, the number of visa extensions is not restricted; allowed to bring family to Japan.
With type I visas, the Government of Japan estimates to receive about 47,750 people in 2019. It is expected that after 5 years, a maximum of 345,140 people will be accepted, including about 60,000 nurses.

2 - Increase the time of skilled trainee programin Japan

This is really good news for Vietnamese workers who wish to work long-term in Japan. Because Skilled trainee program in Japan limits the working time to 3 years. After finishing the contract, if meeting the conditions for passing the skill test in Japan and having a company accepting to work, the trainees will be returned to Japan to work for another 2 years.
However, if the new Law is passed, the working time of employees granted Type II visas will be extended for a long time after 5 years, the number of visa extensions is not restricted. Applicable to 2 industries: shipbuilding and construction. The remaining industries are still in the drafting process.

3 - Have the opportunity to be granted permanent residence in Japan and sponsor relatives to Japan.

 Normally, in the Japan labor export program, only those who go to Japan on the basis of new engineers have the opportunity to work long-term in Japan and guarantee relatives to Japan.
 In 2019, if the new Law is applied, workers who are granted Class II visas will have the opportunity to be granted permanent residence in Japan. Especially, it is allowed to bring families from Vietnam to Japan for living.
 Conditions for obtaining a permanent residence permit in Japan and guaranteeing a relative to Japan include:
After 5 years of extension, the trainee will take the skills test (Japanese language test and skill). If you pass this test, the trainee will be granted the “TOKUTEI GHINO 2 GO” status. In this capacity, trainees may be granted permanent residence in Japan and allowed to bring relatives to Japan to live and work.

4 - Increase the number of Vietnamese trainees to Japan to work.

 Currently, Japan is still in serious shortage of labor in key sectors. Especially, on July 24, 2020, the Summer Olympics 2020 will be held in Tokyo - Japan. Therefore, Japan needs a large number of foreign workers to hastily complete preparations for the 2020 Olympics.
 According to statistics from the Department of Overseas Labor Management, in 2018, there were 142,860 people going to labor export (50,292 female workers) increasing by 6% compared to 2017 (in 2017, the total number of Vietnamese workers going to work abroad is 134,751 workers).
 Besides the industry and agriculture, the nursing industry in Japan also needs to recruit a large number of nurses to work in Japan. Currently, the Government of Japan has planned and recruited 10,000 Vietnamese nurses to export nursing to Japan, from now to 2020.
 Thus, these new changes have brought many benefits to workers when participating in the labor export program in Japan. Especially those who work in construction, agriculture and nursing orders.
